Terms and conditions

FGGubellini is an Italian company and, as such, complies with Italian and European regulations on distance selling. Therefore, purchasing from FGGubellini is safe, there’s no risk of fraud, and any problems will be resolved quickly and with the best possible solution.

By browsing and purchasing on FGGubellini, you automatically accept, without reservation, the terms and conditions (including those of linked pages). It is your responsibility to regularly review these terms and any additional changes posted on the site. Therefore, by accessing and browsing the site, you agree to these terms and conditions.

Accuracy of information and prices

The FGGubellini website is constantly updated. While FGGubellini aims to be 100% accurate, errors may still occur in prices, photographs, descriptions, technical specifications, shipping terms, payment terms, or product return policies. Please report these errors to us via the Contact Us section for immediate correction. If such errors are found in products in an ongoing order, we will contact the customer with the option of canceling the order (with an immediate refund if payment has already been made) or continuing the purchase, evaluating alternative solutions. If the order has already been shipped and received, a return with a subsequent refund is possible. Please visit the Returns and Non-EU Returns pages for more information. FGGubellini reserves the right to cancel orders containing such errors and to correct them without prior notice. FGGubellini is not responsible for any problems or damages resulting from such errors.

Entering false, altered, and/or fabricated information is strictly prohibited.
We reserve the right to take legal action against any violation or abuse, in our own interests, those of users, and institutions.

Prices, VAT and invoicing

Prices on FGGubellini are subject to continuous update. Prices include VAT where applicable for EU countries, and are exempt for orders to non-EU countries and EU companies with VAT numbers enabled for Intrastat transactions (in the latter case, please contact us before ordering). By changing the destination country in the top right-hand corner of the site or in the cart, you will obtain updated prices. Please note that there are no customs duties within the EU and the total paid is inclusive of all costs, unlike for non-EU countries.

Shipping costs are not included in the prices but are listed separately.
“List prices” refer to the suggested retail prices.

Transactions currently always take place in euros (€).

For each order, a receipt is issued, or alternatively, an invoice is issued if the appropriate option was selected during checkout. For non-EU countries, a VAT-exempt invoice is automatically issued. For EU countries, you must select the “I want an invoice” checkbox before the payment process. Otherwise, a receipt will be issued (it will not be possible to request an invoice later).

FGGubellini also offers VAT refunds for non-EU citizens who intend to export the goods received to the EU.

In rare cases, following a VAT increase or a supplier price increase, it may be necessary to revise prices. In this case, our customer service team will contact the customer and will be entitled to a full refund if they deem the increase unacceptable.

Orders

Purchases on FGGubellini (www.fggubellinini.com) are permitted only to adults (over 18 years of age) or minors under adult supervision. FGGubellini assumes that all information provided by the user is true and accurate, that the buyer is the owner of the payment method selected for the purchase, and that there is sufficient credit to complete the payment.
Once the order is received, an order confirmation email will be automatically sent to the address provided during registration with all the details. This email does not establish a contract between the customer and the seller (FGGubellini); it merely summarizes the order proposal submitted by the buyer, which is confirmed only when you receive a confirmation email indicating that the order has been shipped. FGGubellini reserves the right to accept or decline any order received. If the order is rejected, FGGubellini will contact the user and issue a full refund.

In case of a refund, this will be made using the same payment method used for the purchase.

Changes, cancellations and returns

You can always change or cancel an order if it has not yet been marked “Preparing” (visible in the status update email and in the “Orders” section of your user profile). Once it has entered this status, the order cannot be changed, nor can it be cancelled. For more information on how to change or cancel an order, see the Availability and Orders section.
Once you receive the goods, you can always return them by following the order cancellation procedure as provided for by the Consumer Code (please note that you have 30 days to exercise your right of withdrawal from the order, excluding personalized, custom, and made-to-order products).

Order cancellation

It is possible to cancel an order until it reaches the “preparing” status.

After this status, the order is already being processed and, in the case of made-to-order products, they may have already been ordered from the supplier without the possibility of withdrawal.

Cancellations are possible only through the “My Orders” section of your user profile. By clicking the “Cancel Order” button, a request will be submitted and processed within 24-48 business hours, with a subsequent refund issued (more information in Availability and Orders).

Product Guides

Some products include assembly and user guides. These are based on FGGubellini’s experience. We are not responsible for any problems arising from these instructions, as they are written/designed based on standard, common scenarios, without addressing the specifics of each customer.

Order preparation and shipping

Once payment has been confirmed, FGGubellini will immediately process your order. In rare cases, processing and shipping times may be delayed due to warehouse errors, such as simultaneous purchases of limited quantities, incorrect availability, or defective products only discovered when the order is being prepared. These issues will be handled promptly by our customer service team, working with the customer, with maximum transparency and speed. In this case, the customer will be free to cancel the order at any time. Shipping costs are clearly indicated in the cart during the order confirmation process and are included in the total.
Shipping times depend on the chosen service, and once shipped, an email with a tracking code will be sent to track the status of your order. The customer is directly responsible for the accuracy of any information provided. If the package cannot be delivered (for example, due to an incorrect address or recipient not being present) and is returned to the sender, the buyer will be responsible for the return shipping costs (if the free promotional shipping option was used, the corresponding shipping cost will be refunded).
FGGubellini is not responsible for any delays caused by the shipping service (for example, deliveries to remote areas, strikes, natural disasters, unforeseen logistics issues, etc.).
If you encounter any problems, you will always be assisted by our customer service.
For orders to non-EU countries, VAT, duties, and customs/handling charges are not included in the total and are the responsibility of the customer.

Customs clearance for orders with non-EU destinations

In every non-EU country, imported goods undergo customs clearance. When purchasing from FGGubellini, the goods are shipped from Italy. Consequently, the buyer becomes the importer and is therefore responsible for the goods clearing customs in the destination country. As the importer, the buyer assumes full responsibility for customs clearance of the goods as well as for any issues related to inspection or retention.

Please note that customs authorities reserve the right to detain and inspect goods for as long as they deem necessary. Therefore, FGGubellini cannot be held responsible for any delays due to customs clearance.

The import of certain goods, such as products containing pressurized gases or lithium batteries, may not be authorized in the destination country as they are considered “dangerous goods.”

Customs duties, taxes, and/or customs clearance costs (including those for any intermediaries where applicable) may apply to the import of goods and are the responsibility of the customer.

For international shipments, our dedicated office provides couriers with the necessary documentation and information required for shipping. However, if the goods undergo extensive customs inspections, additional documentation may be required. In this case, FGGubellini will do everything possible to provide the buyer with the assistance and documents required for customs clearance.

Environment

Ecology, recycling, respect for the environment. FGGubellini is particularly concerned about the environment; most of the energy we consume is produced from renewable sources (photovoltaic system), significantly reducing CO2 emissions and other pollutants. We pay attention to everything that can be recycled, as well as a home automation system that optimizes resources and the use of energy-efficient LED lighting.

Purchase security and guarantee

FGGubellini is a website that operates in accordance with Italian and European regulations, guaranteeing high standards of service. This is aimed at ensuring all buyers have a pleasant shopping experience, while respecting consumer rights.
FGGubellini is also committed to finding solutions to any issues that may arise and guarantees after-sales assistance.

Right of conformity

Articles 128-135 of the Consumer Code (Legislative Decree no. 206/2005) require sellers to guarantee consumers that the purchased goods meet the characteristics and quality offered. The seller is therefore responsible for any defects in conformity existing at the time of delivery for all products sold in their store. A defect in conformity exists when the product:

• is not suitable for its intended use;
• does not conform to the description or does not possess the qualities advertised by the seller;
• is not suitable for the particular use intended by the consumer, if the consumer was incompletely and/or incorrectly informed by the seller at the time of purchase.
• If a defect is found, FGGubellini requests that the buyer cease using the product and contact us, specifying the problem encountered.

Warranty

All products listed on www.fggubellini.com are covered by an official manufacturer’s warranty; this warranty is valid for 24 months from the date of receipt of the goods.
The warranty applies to products with defects in conformity and/or functionality that were not detectable at the time of purchase.

The warranty also does not apply to incorrect product installation, poor maintenance, abuse or negligence, misuse and/or fraudulent use of the product, alteration of the product, or unauthorized repair attempts. It is important to install, repair, and use the product carefully following the instructions to avoid damage or accidents.

The warranty is personal and therefore applies to the original purchaser. To avail of the repair/replacement of the product, the purchaser must present proof of purchase, such as the order summary with the attached receipt included in the package (issued only for EU countries), the invoice, selected during the order process, etc. It is important that the document shows the date and the items purchased. The profile’s order history is not valid, as these are order proposals.
In the absence of these documents, the warranty cannot be utilized.
Due to the rapid deterioration of the chemical paper used to issue the receipt, FGGubellini recommends the purchaser make multiple copies of it to maintain the possibility of availing himself of the warranty.

Any item repaired or replaced under warranty will also be covered by the warranty for a period equal to the remaining warranty period of the original product.

Any repair costs for items not covered by the warranty will be communicated to the buyer in advance by email. The consumer can then decide whether to have the item repaired or receive it as is.
If the product cannot be repaired or replaced, FGGubellini reserves the right to offer an alternative of equal or greater value or a partial refund.

Repair/replacement times for items under warranty vary depending on the manufacturer. It is therefore not possible to establish a specific warranty processing time in advance.

Before sending a product under warranty, you must follow the procedures in the Returns and Non-EU Returns sections (without a return number, delays or the shipment may be returned to the sender).

Assembly

FGGubellini is not responsible for any damage caused by the installation of a received product. We strongly recommend inspecting the goods before handing them over to your trusted mechanic or assembly partner (also ensure they are competent in the product specifications). We also ask you to read the warranty conditions before installing or repairing a product (some manufacturers require qualified personnel, failing which the warranty will be voided). FGGubellini cannot be held responsible if the item is damaged or the warranty is voided.

Additional responsibilities

FGGubellini is not responsible for any direct or indirect damages resulting from the sale of goods on its website.
FGGubellini is not responsible in any way for the fraudulent or illegal use of its website, its services, or for any type of payment from third parties.
FGGubellini declines all liability for damages of any kind, direct or indirect, or resulting from loss of data, income, or profits, loss of or damage to property, and implicit or explicit claims of third parties relating to the use of its website. FGGubellini does not claim ownership of any content posted by the user on FGGubellini pages (including those of linked social networks). The user grants FGGubellini a transferable, non-exclusive, royalty-free right to reproduce the content, directly or indirectly, temporarily or permanently, in whole or in part, worldwide.

This procedure may involve costs for both parties, depending on the body chosen to arbitrate the dispute.
